§ 30-63. Definitions.

  • The following words, terms and phrases, when used in this division, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Abutting foot means property contiguous and adjacent to a water line.

    Approach or off-site mains means water mains totally outside of a tract of land to be subdivided and developed for resale or the owner's use. A main adjacent to a tract of land to be subdivided and developed shall not be considered to be an approach main.

    Consumer means the actual user of water from a city water connection.

    Developer means the owner or agent of the owner subdividing and installing utilities to serve lots or tracts for resale, lease or own use.

    Frontage means property abutting either side of a water line.

    Oversize cost means the difference between the actual cost of the main as built and the size of main determined to be the minimum size required to serve the subdivision. Only those mains larger than 12-inch mains shall be considered for oversize cost. Consideration shall be given only if such larger mains are required to serve land not owned by the developer.

    Property owner means the record title holder of premises served with water from a connection by the city.

    Water system means all lines or mains required by the city to adequately serve the developed area described in this article, including any ground storage or elevated storage tanks, towers, pumps, appurtenances and the site for the same.
